PRO-ACTIVE DISCLOSURES UNDER RTI ACT 2005

 

(i) Particulars of Organisation:

 

Ordnance Factory Kanpur is one of the leading factories working under Ordnance Factory Board, Ministry of Defence, Government of India with an objective to meet the requirement of Indian armed forces for defence hardware. This factory is situated 15 km away from Kanpur railway station.

 

(ii) The Powers and duties of its officers and employees

 

OFC is headed by The Sr. General Manger/ General Manger officer of HAG/SAG grade. Sr. GM/GM has been delegated with full Administrative and Financial powers of ‘Head of the Department’ which would be essential for the efficient functioning of the factory.

 

Sr. General Manager/General Manger has further delegated his powers to the officials down the line of control i.e Additional GM, Joint GM, Dy. GM, WM, AWM to levels which are required for the operation of functional entities.

(iii) The procedure followed in the decision making process, including channel of supervision and accountability :

OFC is headed by Sr General Manger/General Manager, an officer of HAG/SAG grade, the CEO of the factory. He is the final decision taking authority for all administrative and financial matters. He also exercises administrative and financial power as Head of the Department.

He is assisted by Additional General Managers having SAG grade discharges the duties of controlling officer/Divisional Heads of different Divisions. Next in hierarchy is Jt GM (JAG) Grade, DGM (STS-NF), Works Manger (STS), Assistant Works Manager (JTS).

Below them are Group-B Officers and Group-C Staff. Employees directly engaged in production activities are called Direct Workers. Indirect Workers provide support activities like maintenance of buildings and plant & machineries, quality assurance etc.

Since it is an industrial set up it is desired from management to involve representatives of various trade/staff unions while formulating/implementing any new policy/decision/concept for betterment of the organisation/workers/staff. Hence major decision taken at apex level are normally discussed in works committee/JCM.   

Administrative decisions pertaining to personnel are taken through the hierarchical Chain based on the extent of delegation provided to the executives.

 

Financial decisions are taken by executives within the powers delegated to them.

 

The affairs of the factory are regulated as provided in various Acts viz, The Factories Act, Payment of Wages Act, Workmen Compensation Act, Pollution Control Act etc. A Local Accounts Office is attached with the factory to advise Senior General Manager/ General Manager on financial aspects.

 

In the factory, there are some Deputy Labour Welfare Commissioner or Assistant Labour Welfare Commissioner from Ministry of Labour, who assists Senior General Manager/General Manager in taking decision(s) on industrial relation(s).

 

Supervision and accountability are clearly defined. Any lapse in the production shop is attributed normally to the supervisory staff starting from Chargeman (Tech.) to Junior Works Manager (Tech.). Accountability for overall supervision of the whole section rests on Head of Section/ Officer-in-Charge of the concerned Section. Each Production Section is headed by Junior Works Manager (Group ‘B’ Gazetted). They are fully accountable to ensure unhampered operations in the section under their charge. Next level of accountability starts with the Divisional Officer, Group Officer and Controlling Officer/Divisional head. They are responsible for planning, co-ordination and to deal with external agencies like concerned inspection agency of the user. Overlapping of responsibility and accountability in the present system cannot be ruled out.

 

 

(iv) The norms set by it for the discharge of its functions

 

            The basic function of ordnance factory is to achieve the production target allotted by OFB. Though work is divided in various sections but all are supposed to act in a team manner as failure of one section may lead to failure of achieving overall objective of production target. Hence at higher level more than one activity is merged to get the work done in a team sprit and time bound manner.  

 

            OFC manufacture such products and equipments for customers which are safe, reliable, and operationally consistent under varying and extreme conditions of terrain and climate. With the large number of items being manufactured in OFC, it is necessary that strict vigil on the numbers and quality is kept. Besides, it is also important to keep the assets – both animate and inanimate in shape. OFC has, therefore, set certain norms for discharge of its functions in different areas as below:

(i) Production: Annual (Monitoring on monthly basis)

 

(ii) Maintenance: Immediate (Monitoring on daily basis)

 

(iii) Purchase:                         On six monthly basis for production and maintenance items

                                                            On quarterly basis for indirect items

           

(iv) Stores material:   Stores in hand should not exceed 180 days of requirement

                                                           

(v) Stock Verification: Once in a year for any item (all items)

           

            (vi) Stock Taking:      Annual on 31st March of the year

           

            (vii) Quality:   Inspection on daily basis

           

            (vii) Recruitments:     As per sanction received from OFB

 

            (viii) Promotions:        Annual (Effected on monthly basis)

 

            (ix) Training: All Group ‘A’, Group ‘B’ Officers, NGOs/NIEs/IEs

 (v) The rules, regulations, instructions, manuals and records held by it as under its control as  used by its employees  for discharging its functions

 

There are various set of Rules and regulations for discharging its various functions. Rules and Regulations are also available for dealing with the agencies with which our organisation interacts, to deal with its own employees, for proper utilisation of public resources and for ensuring timely and efficient production of vital items required by our armed forces, para-military units and other customers. Although the list of such Rules, Regulations and instructions are very large in number, the following is the frequently used list:

 

(i) OFC is a production unit employing a large number of workers. Factories Acts 1948 provides in detail the facilities which are to be made available to the workers. Provisions of this Act also lays down provisions for providing safe working conditions for the workers. This act also takes care of regulations in working hours of industrial employees including payment to be made for overtime working. This Act also provides for inspection by factory inspectors for proper monitoring of the application of the provisions.

 

(ii) For contract workers, their wages are safeguarded by Minimum Wages Act, 1948. This Act provides for the lower limit for the wages which has to be ensured for the contract worker. CONTRACT LABOUR(R&A) Act lays down specific responsibility for the Principal Employer and various other social security measures like provident fund, Employees State Insurance, etc. to be ensured for contract workers. Contract labour (R&A) Act, 1970, is the main instrument in ensuring non-exploitation of unorganized workers serving in our organisation under the contractors.

 

(iii) The organisation enters into various types of contracts for purchase of material/services, etc. Indian Contract Act provides the conditions which are essential for a valid and enforceable contract.

 

(iv) To safeguard the environment we follow the law laid down by Pollution Control Act of the State Govt, which lays down criteria for effluents/emission etc.

 


(v) The employees of our organisation belong to Central Civil Service and their conduct is to be governed by Central Civil Service (Conduct) Rules, 1964. Provisions of this Rule ensure that the government servant discharges his duty with loyalty and devotion at all times and does nothing which is unbecoming of a Govt. servant. It also mentions about certain sanctions etc. which are to be taken for property transaction. Thus, Conduct Rules ensures that Govt. servant conduct is impeccable at all times and the general public has faith in the Government machinery. Conduct Rule also lay down guidelines for how to deal with public representatives and how the govt. servant should conduct himself in public.

 

(vi) To maintain proper disciplined environment in our factories, offices, training centers, etc. we follow the provisions of Central Civil Services (Classification, Control & Appeal) Rules 1965. These rules are based on the principle of Natural justice and have elaborate provisions regarding disciplinary authority, suspension, enquiries, penalties, appeals, revision, etc.

 

(vii) In financial matter, Rules laid down in GFR are applicable which lay down basic principles for decision regarding financial transaction. FRSR (Fundamental Rules & Supplementary Rules) are relevant in salary fixation, allowance, etc. For further guidance in financial matters, Financial Regulation is also referred to. Matter regarding traveling allowances is dealt by TR Rules. Delegation of financial power is enlisted in DFPR. Regarding financial power of General Managers under various heads, instruction of OFB, Kolkata is followed.

 

(viii) SRO for various posts are followed for the number of post sanctioned, recruitment/promotion eligibility, scale of pay, etc.

 

(ix) For quarter allotment in our factory estates, ‘SRO 149/2004 for quarter allotment in Ordnance Factories and Ordnance Equipment Factories is followed.

 

(x) Pension matters are dealt by CCS (Pension) Rules, 1972 and New Pension Scheme. These rules provide for various kind of pensions like superannuation, family pension etc. In addition they deal with matter related to Voluntary Retirement, commutation of pension and various other retirement matters.

 

(b) Office works are carried out according to ‘Office Procedure Manual’. This Manual contains details of Noting, drafting, filing system, etc. This ensures proper record keeping and monitoring of file movement.

 

(c) In the field of Material Procurement, Defence Procurement Manual and Ordnance factory Board’s Purchase & Procurement Manual is followed.

 

(d) For accounting of labour and material Store Accounting Procedure is followed.

 


(e) For leasing and licensing of facilities in estates we have a Land Lease Policy, 1990 approved by the government. It provides for the method adopted/criteria to be followed for leasing out land for market, school, banks, etc.

 

(f) Detailed instructions issued by DOP&T based on rules in the matters of recruitment, promotion, reservation etc. are followed.

 

(g) CVC instructions received from time to time are followed for ensuring transparency and impartiality in purchase matters.

 

(h) In construction of building and other facilities, the standard rates and estimates given in MES regulations are followed.

 

(i) In OFC, ISO 9001 systems are incorporated to ensure quality output, customer satisfaction and continued improvement in our methods. Work is carried out on the production shop floor as per the Standing instructions.

 

 

(vi) A statement of the categories of documents that are held by it as under its control

 

 OFC  holds the following documents :-

 

Ø      Extracts issued by OFB

Ø      Various Tender enquiries, case files related to procurement.    

Ø      Personal files and service book (including leave account) of its employees

Ø      Pay rolls

Ø      Cash book

Ø      Circulars/factory orders for internal administrations of factory

Ø      Maintenance of Annual Performance Appraisal Reports

Ø      Case files containing  Recruitment/Promotion/MACP matters

Ø      Disciplinary  action  related files

Ø      Pension Payment Orders of retired employees

Ø      Court related litigation files

Ø      Purchase  orders related files

Ø      Vendor registration forms

 

(vii) The particulars of any arrangement that exists for consultation with, or representation by the members of the public in relation to the formulation of its policy or implementation thereof :

 

Problems/issues deserving reforms are raised by the concerned section or affected personnel. The concerned section make a procedural draft to resolve the issue and then it is discussed at various forum i.e. JCM, Mangers meetings, Works Committee etc.. Suggestions are invited and accordingly revised procedure is drafted in a manner that it will be accordance to the rule set by government of   India. After getting approval of apex level, the said procedures is being implemented

 

(viii)   A statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advise, and as to whether meetings of those boards, councils, committees and other bodies are,open to public, or the minutes of such meetings are accessible for public :

 

Internal meetings in OFC takes place at various level form time to time

 

1) JCM-IV - It is top management body having representative of nominated members of unions and management. Decision taken in the meeting are final in nature.  

 

2) WORKS COMMITTEE – Elected members from workers as well as 10 nominated members from management side participates in the meeting. Usually it take place once in three month, it is recommendatory body.  

 

3) TPC - related to material procurement

 

4) Safety Committee – discussing the safety norm 

 

5) Local Productivity Council - It consists of Controlling Officers of different production/Maintenance divisions and representatives from JCM-III (Apex), JCM-IV. The LPC meets at alternate months to discuss the matters which affect productivity and to take necessary decisions to improve productivity.

 Factory has its own telephone exchange facility. Any citizen can contact concern employee /officer through exchange run by OFC.

(xi) The budget allocated to each of its agency, indicating the particulars of all plans, proposed expenditures and reports on disbursement made :

 

The budget allocated to the OFC for the Financial Year 2010-2011 is
` 4,28,54,00,000.00.  The entire amount is “non-plan” and is meant to incur expenses on account of material procurement, salary, wages, medical treatment, domestic and foreign official travel, office expenses etc.  Out of the budget allocated for the current financial year, the total expenditure made till 28.02.2011 is ` 3,77,71,00,000/-.

 

(xii) The manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiary of such programmes :

 

No subsidy programmes are executed by the OFC and no amount is allocated to it for the purpose.

 

(xiii) Particulars of concessions, permits or authorization granted by it :

 

       Concessions, Permits or Authorization are granted by the OFC in accordance with instructions received from time to time by Ministry of Defence, Govt. of India.

 

(xiv) Details in respect of the information available to or held by it, reduced in on electronic form

(xv) The particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use.

 

The citizens can obtain information from the OFC under RTI Act 2005 through correspondence by sending 10/- rupees cash against proper receipt or DD/Banker’s cheque / Indian Postal order in favour of General Manager, OFC.
